End User License Agreement
IMPORTANT – READ CAREFULLY: This End User License Agreement (“EULA”) is a legal agreement between you and Simplify for the use of the Simplify software (“Software”). By installing, copying, or otherwise using the Software, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install or use the Software.
License Grant. Simplify grants you a non-exclusive, non-transferable license to use the Software solely for your internal business purposes on the Atlassian Cloud Platform.
Ownership. Simplify retains all rights, title, and interest in and to the Software and any modifications, enhancements, or derivative works of the Software. You acknowledge that you do not acquire any ownership rights in the Software under this EULA.
Restrictions. You may not:
- (a) copy, modify, distribute, sell, or transfer the Software or any portion thereof;
- (b) reverse engineer, decompile, or disassemble the Software, except to the extent that such activity is expressly permitted by applicable law;
- (c) use the Software to create any competing product;
- (d) remove or modify any copyright, trademark, or other proprietary notices from the Software;
- (e) use the Software for any illegal purpose; or
- (f) use the Software in a way that interferes with or disrupts the Atlassian Cloud Platform.
Support. Simplify may provide support for the Software as described in the Atlassian Marketplace listing. Any support provided is subject to this EULA.
Data Security and Privacy. Simplify offers apps for Jira Cloud and Confluence Cloud based on the Atlassian Forge platform. No data is stored or processed on systems managed by Simplify, only by Atlassian themselves. Please refer to the Simplify Data Security and Privacy Statement for more information.
Limitation of Liability. TO THE MAXIMUM EXTENT PERMITTED BY LAW, Simplify SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE USE OR INABILITY TO USE THE SOFTWARE, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, BUSINESS INTERRUPTION, OR LOSS OF DATA, EVEN IF Simplify HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Governing Law. This EULA shall be governed by and construed in accordance with the laws of Serbia, without giving effect to its principles of conflicts of law.
Entire Agreement. This EULA constitutes the entire agreement between you and Simplify with respect to the Software and supersedes all prior or contemporaneous oral or written communications, proposals, and representations with respect to the Software.
Updates. Simplify may update this EULA from time to time. Any updates will be posted on the Atlassian Marketplace and will be effective immediately upon posting.
No Liability. To the maximum extent permitted by law, you agree that Simplify shall not be liable for any loss, injury, claim, liability, or damage of any kind resulting in any way from your use of the Software.
